    Eligibility of FMCS BIS Certification

    1. The manufacturing unit should be located outside of India.
    2. Ensure conformity of their product(s) to applicable Indian Standards Specification (ISS).
    3. At the factory premises, all manufacturing machinery and testing facilities should be available.
    4. Product testing equipment and quality control personnel should be available in-house laboratory to test the product as per applicable ISS.
    5. The manufacturer should accept the Scheme of Inspection & Testing(SIT) and the annual marking fee.
    6. The company/manufacturer (FMCS) should accept the terms and conditions of the Licence.

    Note – Separate applications shall be submitted for each product and each factory location.

    Scheme of Inspection and Surveillance

    Periodic Audits: Manufacturers may be subject to periodic audits to verify the continued conformity of their products and manufacturing processes with the specified standards.

     

    Sampling and Testing: BIS may conduct random sampling and testing of certified products to ensure ongoing compliance with quality and safety standards.

    Renewal of licence

    The licence is granted initially for a period of up to two years.

    The renewal of the license may be considered for a period of not less than one year and up to five years depending upon whether the annual license fee and advance minimum marking fee has been paid for.

    If the renewal application is made after the validity of the license, the application shall be accompanied by a late fee of rupees five thousand.

    Renewal request shall contain:

    1) Renewal application ( Form XII )

    2) Production detail (Month) including complete consignees/ stakeholder address

    3) Extended Performance Bank Guarantee (six months more than the validity of the license)

    4) Remittance of applicable marking fees

    1. What is BIS FMCS?

    FMCS is a certification scheme for a Foreign manufacturer who wants to get certified under the  BIS Licence scheme.

    FMCS scheme is mandatory for the grant of licenses for all products other than Electronic and Information Technology Products.

    1. Is BIS License mandatory for importing products in  India?

    Generally, the certification scheme of BIS is voluntary, however, for certain products as notified by the Government of India under Quality Control Orders, they can be imported to India only with Standard Mark under a valid license from BIS.

    1. How to apply For BIS License?

    An application needs to submitted in the prescribed format along with all the necessary documents.

    1. Is nomination of AIR (Authorized Indian Representative) mandatory?

    Nomination of AIR is mandatory.

    1. Whom would be considered as an AIR?

    The AIR shall be an Indian resident and shall declare his consent to be responsible for compliance with the provisions of the BIS Act, rules, regulations, and terms & conditions laid down in BIS Licence, Agreement, Undertaking, etc. AIR is representative of one manufacturing firm only and doesn’t represent other foreign manufacturers (s) as AIR under the BIS Conformity Assessment schemes. However, in the case of foreign manufacturers belonging to one group of companies and importers (related to the foreign manufacturer) nominated as AIR, the restriction shall not be applicable

     

    1. Had the AIR to be an Indian resident only?

    The AIR should be an Indian national; a resident of India.

    1. Is the payment made to BIS in USD or INR?

    For SAARC (South Asian Association for Regional Cooperation) countries i.e. Afghanistan, Bangladesh, Bhutan, India, Nepal, the Maldives, Pakistan & Sri Lanka,  the payment can be made in USD or Indian Rupee (INR) with GST. For other countries, the payment should be made in United States Dollars only.

    1. Whether the test report as per IEC or any standard other than the Indian Standard be accepted?

    No, it is not acceptable, only the test report as per relevant Indian Standards is accepted.

    1. Whether the sample of the product drawn during inspection can be tested in any ILAC/APLAC-approved lab or, any Govt. lab in the country of the manufacturer?

    It will be tested only in BIS Approved Laboratories. The sample drawn by BIS shall be sent to the Laboratory in India by the applicant firm. Testing charges to be borne by the manufacturer.

    1. What is the timeline for the grant of the license?

    The average time taken for the grant of a license is generally six months from the date of receipt of the complete application and its recording. It may vary for reasons like delay in response to queries raised, if any; organizing inspection(s); transportation of samples and remittance of dues.

    1. Can I submit one application for different products/ISS being manufactured at the same factory location?

    Application for each IS needs to be submitted individually.

    BIS is a manufacturer-concerned license, hence the application needs to be submitted only by the manufacturer. However, the importer can act as an AIR and help in the registration process.

    BIS certification under Scheme-I may be granted initially up to two years after payment of the advance minimum marking fee. The license is valid only for the varieties mentioned in the license.
