    Brief 

    The Food Safety and Standards Authority of India FSSAI is addressed by the Ministry of Health and Family Welfare, government of India.FSSAI is the agency responsible for the nationwide food industry in India. it ensures that each product receives an appropriate quality check.

    In the FSSAI Registration process, the FBO will get a 14-digit number that needs to be printed on food packages or displayed on-premises. FSSAI 14-digit license number gives data about the producer’s permit or enrollment subtle elements and the assembling state.

    Governing law 

    The Food Safety and Standards Authority of India FSSAI is a legal authority that provides food licenses to every food business operator FBO in India according to section 3 [ 1]  of the FSS Act 2006 and Food Safety and Standard Rules 2011, which reinforces statutes related to food security and regulation in India.

    Stakeholders eligible for FSSAI license 

    All food business operators, including pharmacies or medical stores selling health supplements or nutraceutical products, must apply for the FSSAI license or registration. 

    Hawkers, food vendors, food chains, and all other stakeholders operating in the food industry must obtain registration with FSSAI, irrespective of whether they operate online or offline. Depending on the size and locations of their operations, stakeholders must obtain one of the three types of licenses available: FSSAI basic registration, FSSAI state license, or FSSAI central license. 

    If a stakeholder’s business falls in any of the following categories, they must get an FSSAI License for their business.

    • Petty retailers, retail shops, snacks shops, confectionery or bakery shops 
    • Temporary stalls, fixed stalls or food premises are involved in preparing, storing, distributing and selling food products.
    • Hawkers sell packaged or freshly prepared food by travelling from one location to another.
    • Dairy units including milk chilling units, petty milkmen and milk vendors 
    • Slaughtering house 
    • Fish processing, meat processing and unit.
    • All food manufacturing units that include repacking food
    • Vegetable oil processing units 
    • Proprietary food and novel food 
    • cold/ refrigerated storage facility 
    • Transporter of food products having several specialized vehicles like insulated refrigerated vans / wagons, milk tankers, food wagons, and food trucks.
    • Whole sellers, suppliers, distributors and markets of food products 
    • Hotels, restaurants and bars 
    • Canteens and cafeteria including mid-day meal canteens

    FSSAI Registration is provided based on the business types, turnover and production capacity According to the installed capacity and turnover, FBOs are eligible for essential central and state licenses. 

    Types of FSSAI license 

    FSSAI basic registration 

    FSSAI Registration is mandatory for petty food manufacturers or the FBO having a turnover of less than 12 lakhs. the petty FBO who manufactures or sells food items, a hawker, small retailer, itinerant vendor, temporary stall- holder or small-scale industries relating to food business who comply with the following conditions must obtain an FSSAI registration certificate.

    Turnover limit 

    Annual turnover does not exceed Rs 12 lakh 

    Capacity 

    Food production capacity excluding milk and meat – up to 100 kg/ltr per day 

    Procurement, handling and collection of milk          –   up to 500 ltr per day 

    Slaughtering capacity                                                    –  two large animals, ten small animals or   

                                                                                                  50 poultry birds per day or less 

    Application filing 

    An application would be filed in form A.

    Fees for registration 

    Fixed at RS 100 per year.

    FSSAI license 

    FSSAI License is mandatory for businesses having a turnover of more than 12 lakh or by the FBO engaged in food processing and manufacturing. FSSAI license carries 14 digits. the FSSAI license is categorized into two types central and state license. FBOs need to get the state license or the central license depending on the size of their business.

    Turnover limit

    Companies have an annual turnover of more than RS 12 lakh.

    Size of business  

    Medium and large-sized food business operators and food businesses 

    Duration 

    Issued for a period of a minimum of one year and a maximum of five years.

    Application 

    An application would be filed in form B.

    Fees for registration 

    It varies from RS 2000 to RS 7500 per year, depending on the criteria and type of license.

    Types

    FSSAI state license 

    Medium-size processors, manufacturers, traders, marketers or transporters require the FSSAI state license from the state government.

    The FBO has an annual turnover of more than RS 12 Lakh but not exceeding RS 20 crore, is considered a medium-sized FBO and must obtain a state license. 

    The FBO must get a central license when its annual turnover crosses RS 20 crore.

    FSSAI central license 

    A large-sized business processing, transporting, manufacturing and having international trade of food products must obtain the FSSAI  central license. the FBO having an annual turnover of more than RS 20 crore is considered a large business and must obtain an FSSAI central license from the central government. 

    Issuance of FSSAI certificate 

    Petty food business operators FBO who manufacture or sell any article of food or petty retailer, hawker, itinerant vendor or temporary stall holder or small scale or cottage or such other industries relating to food business or tiny food business operator having annual turnover up to RS 12 lacs and whose 

    • The production capacity of food products does not exceed 100kg or litres per day.
    • Procurement or handling and collection of milk is up to 500 litres of milk per day 
    • Slaughtering capacity is 2 large animals 10 small animals or 50 poultry birds per day or less 

    These FBOs are required to obtain an FSSAI registration certificate by applying on a food safety compliance system or Food Safety Connect app. This registration certificate is embedded with a QR code and has the image of FBO with a 14-digit registration number. 

    Fees for FSSAI license 

    Basic registration – fee of Rs 100 

    State license        – fee between Rs 2000 to 5000 [ depends on the type of business carried out ] 

    Central license  –    fee of Rs 7,500

    Categories for whom FSSAI license  is mandatory 

    FSSAI has issued directions for risk-based inspection vide order number RCD – 02001/9/2021 regulatory – FSSAI dated 2 May 2022 wherein pre-license inspections have been mandated for the following categories of manufacturer/processor.

    • Milk & milk products
    • Meat & meat products 
    • Fish & fish products 
    • Fortified rice kernels[ FRK ]
    • Slaughterhouses 

    In the remaining categories of the food business, it is advised that no pre-licensing inspection is required and a license may be granted based on the submission of mandatory documents for the license.

    Consequence of non-compliance  

    Stakeholder under the FSSAI has to adhere to the rules and regulations under the FSS Act 2006. the food safety officer generally inspects the food business operator’s facility and identifies the level of compliance with the regulation using a checklist. the food safety and standards officer marks according to the level of compliance such as –

    The food safety officer might have an issue with the improvement notice wherever it is required per section 32 of the FSS Act 2006. if the business operator fails to comply with an improvement notice. the officer after giving the licensing opportunity to show cause may cancel his license.

    Legal action 

    Any food business operator aggrieved by an improvement notice can appeal to the state commissioner of food safety The decision thereon can be challenged by appealing to the food safety appellate tribunal / high court.

    Document required 

    The following documents are mandatory for FSSAI registration. 

    • Photo of the food business operator 
    • Government-issued photo ID including Aadhar card, PAN, voter ID 
    • Proof of business activity address – rent agreement and electricity bill 
    • Company incorporation documents like certificate of incorporation / MOA & AOA / partnership deed / LLP certificate.

    Validity of FSSAI license/registration

    The FSSAI License/registration will be issued for 1 to 5 years as chosen by the food business operator from the date of issue of registration or license.

    Renewal 

    The FBO must apply for renewal 30 days before the expiry of the current license.

    Responsibility of food business operator 

    Food business operators shall ensure that the following conditions are complied with at all times during their food business.

    • Display a true copy of the license granted in form c at all times at a prominent place on the premises.
    • Provide necessary access to licensing authorities or their authorised personnel to the premises.
    • Inform authorities about any change or modification in activities/content of the license.
    • Employ at least one technical person to supervise the production process.
    • Furnish periodic annual returns from 1 April to 31 March from up to 31 May each year for collection/handling/manufacturing of milk and milk products. Half-yearly returns are also to be furnished as specified from 1 April to 31 September before 30 November and 1 October to 31 March.
    • Maintain factory sanitary and hygienic standards and worker’s hygiene as specified in schedule -4 according to the category of food business.
    • Maintain daily records of production, raw material utilisation and sales separately 
    • ensure that the source and standards of raw material used are of optimum quality 
    • Food business operators shall not manufacture, store or expose for sale or permit the sale of any article of food in any premises not effectively separated to the satisfaction of the licensing authority from any privy, urinal sullage, drain or place of storage of foul and waste matter.
    • Ensure a clean-in-place system for regular cleaning of the machine & equipment.
    • Ensure testing of relevant chemical and microbiological contaminants in food products following these regulations as frequently as required based on historical data and risk assessment to ensure production and delivery of safe food through own or NABL accredited /FSSAI notified labs at least once in six months.
    • Ensure that as much as possible the required temperature shall be maintained throughout the supply chain from the place of procurement or sourcing till it reaches the end consumer including chilling, transportation, and storage.
    • The manufacturer/ importer/ dismantler shall buy and sell products only from or to licensed/registered vendors and maintain a record thereof 

     

    Responsibility of the designated officer 

    • No pre-license inspections shall be conducted in cases other than those mentioned for risk-based inspection. 
    • In the case where the designated officer believes that it is necessary to inspect the non-mandatory category, he/ she shall record the reason in writing with clear justification.
    • Once an application is marked for inspection in non-mandatory categories, inspection should be done within 15 days In case inspection is not conducted within 15 days designated officer should recall the application back to the document scrutiny stage in FoSCoS and grant the license.
    • The designated officer still believes that the inspection is necessary to be conducted before granting the license, he/she can reassign the inspection to another FSO or himself/herself for immediate inspection without any further delay.

     

    Provision of annual return submission 

    The provision for filing of revised returns will come into effect from 06.01.2024 for annual returns of FY 2022-23 for which the last date of submission of original return was 31 May 2023 and extended till 30 june 2023 vide order dated 09.06.2023. This issues with the approval of the competent authority.

    Re-consider annual return submission by stakeholder 

    FBO manufacturers and importers are allowed to revise/update the already filed annual returns only till the last submission date by 31 May. with the approval of the food authority, the provision to update /revise annual returns in FoSCoS after 31 May has been enabled to rectify inadvertent mistakes subject to the following conditions and fees.

    Compliant FBOs who have filed annual returns by 31 May of the following year 

    Revision of the annual return is allowed a maximum of two times and the last submitted annual return will be considered final. the revised filing fee applicable is as follows –

    1. Revising within three months by 31 August of the following year – one-year license fee + GST
    2. Revising beyond three months 01 September to 31 March of the following year – two year license fee + GST. 

    FBOs who have filed annual returns beyond 31 May of the following year with late fee 

    Only one-time revised/updated filing of annual returns is allowed till 31 March of the following year, with a revised filing fee equal to two year license fee + GST.

    Revised filing of annual returns is not allowed for the original annual returns filed beyond 31 March of the following year  

    If an FBO files a delayed annual return [ first time] for FY 2022- 23 on 1 April 2024 for which the due date was 31 May 2023 in such cases FBOs are not allowed to file a revised return.

    Penalty levied for annual return submission

    FSSAI [ licensing and registration of food businesses ] regulations 2011 specifies the condition for submission of annual returns by manufacturers and importers by 31 May of every year for the food business activities being handled by them during the previous financial year. 

    FSSAI  order dated 18 December 2020 has made it mandatory to file the annual return for FY 2020-2021 onwards through online mode in FoSCoS only. Further, FSSAI vide order dated 10.11.2022 has capped the maximum amount of penalty levied due to filing RS 100 per day to 5 times the annual license fees.

    Launch of food safety and compliance system FoSCoS

    FSSAI is launching its cloud-based, upgraded new food safety compliance online platform called the Food Safety and Compliance System FoSCoS. it will replace the existing food licensing and registration system [ FLRS]. FoSCoS is conceptualized to provide a one-stop for all engagement of an FBO with the department for any regulatory compliance transaction. FoSCoS has been integrated with the FoSCoRIS mobile app and will soon integrate with the present IT platforms of FSSAI, such as INFOLNet, FoSTaC, FICS, and FPVIS.

    A single regulatory platform will enable a pan-India integrated response system to any food fraud and ensure an advanced risk-based, data-driven regulatory approach. For the start, FoSCoS will be offering licensing, registration, inspection and annual return modules.  

    Return submission 

    In adherence with FoSCoS, the modules for filing online annual returns shall also be available delayed returns due to postal delays, the need to preserve dispatch/receipt proofs and disputes regarding submission of returns resulting in harassment of food business operators will be eliminated. mandatory documents have been rationalised and many paper-based declarations have been replaced with tick-based declarations. the central theme is to enhance the ease of doing business for the business operators and enhance user     Mechanism of fortified rice, fortified rice kernels and premix for FRK 

     

    FSSAI has received references from various stakeholders including the Department of Food and Public Distribution, FRK manufacturers and rice millers regarding strengthening the quality control mechanism for the manufacturing and distribution of FRK and resultant fortified rice in the country. 

     

    FBO manufacturing FRK and premix for FRK shall be required to obtain only the FSSAI license 

    [ central / state ].

     

    The transition time of FSSAI registration 

     

    FBOs who are operating under FSSAI registration for the said product are directed to apply for central / state license as per the eligibility. a transition time of three months is hereby given to existing registered FBOs to shift to license and utilize the packaging and labelling materials, if any, failing which, the said two products shall be removed from their existing registration certificates RC to debar them from further manufacturing under RC.

    The procedure for an FSSAI license 

     

    FRK premix and FRK manufactured by the concerned manufacturing FBO including those manufacturing on registration certificate shall be tested for relevant parameters as prescribed under FSSR and the test report shall be uploaded on FoSCoS by the FBO mandatorily .furher during uploading of such reports, manufacturers of FRK and premix for FRK shall also submit self- declaration covering the details such as source of iron used and the blending ratio of FRK with rice for every batch of production of FRK on FoSCoS portal. the testing of FRK premix and FRK shall be carried out only through the FSSAI-notified laboratories.

     

    To ensure traceability, manufacturers of fortified rice and FRK shall procure raw materials only from FSSAI-licensed vendors with a copy of the lab report of the testing of FRK and premix tested only through FSSAI-notified labs.

     

    Criteria for stakeholders under FSSAI license 

     

    • Proprietors of hotels, restaurants and other food stalls who sell or expose for sale savouries, sweets or other articles of food shall put up a notice board containing separate lists of the articles which have been cooked in ghee, edible oil, vanaspati and other fats for the information of the intending purchasers.

     

    • Food business operators selling cooked or prepared food shall display a notice board containing the nature of articles being exposed for sale.

     

    • Every manufacturer including ghani operator or wholesale dealer in butter, ghee, vanaspati edible oil, de-oiled meal, edible flour and any other fats shall maintain a register showing the quantity of manufactured, received or sold, nature of oil seed used and quantity of de- oiled meal and edible flour used as applicable and the destination of each consignment of the substances sent out from his factory or place of business, and shall present such register for inspection whenever required to do so by the licensing authority.

     

    • No producer or manufacturer of vegetable oil, edible oil, and their products shall be eligible for license under this act unless he has his laboratory facility for analytical testing of samples.

     

    • Every sale or movement of stocks of solvent-extracted oil, semi-refined or raw grade 1, edible groundnut flour edible coconut flour or both by the producer shall be a sale or movement of stocks directly to the registered user and not to any other person and no such sale or movement shall be effected through any third party.
    • Every quantity of solvent-extracted oil, edible groundnut flour edible coconut flour or both purchased by a registered user shall be used by him in his factory entirely for the purpose intended. It shall not be re-sold or otherwise transferred to any other person.

     

    • Provided that nothing in this sub-clause shall apply to the sale or movement of the following –

                 

                a.karanjia oil  

                b.kusum oil

    1. mahua oil 
    2. Neem oil 
    3. Tamarind seed oil
    4. Edible groundnut flour bearing the ISI certification mark 
    5. Edible coconut flour bearing the ISI certification mark 

     

    • No food business operator shall sell distribute offer for sale dispatch or deliver to any person for sale any edible oil which is not packed, marked and labelled in the manner specified in the regulation unless specifically exempted from this condition as addressed by food safety commissioners in specific circumstances. 

                 

    Seizure of articles of food by the food safety officer 

     

    For every article of food seized under clause b of sub-section 1 of section 38 of the act, a receipt in form 11 shall be given by the food safety officer to the person from whom the article of food was seized.

     

    The food safety officer keeps any article of food in the safe custody of the food business operator under clause c of sub-section 1 of section 38 of the act.

     

    • On the article of food, make an order to the food business operator in form 3 and the food business operator shall comply with such an order.
    • The food business operator is to execute a bond in Form 4.

     

    Sample and analysis 

     

    The food safety officer while taking a sample of food for analysis under clause A of sub-section 1 of section 38 and section 47 of the act, shall also follow the procedure specified hereunder –

     

    • Shall call one or more witnesses at the time of lifting of the samples.

     

    • Obtain the signatures from the witnesses in all the forms and documents prepared 

     

    • Serve the notice in form 5A to the business operator then and there.

     

    • Food business operator discloses that the product has been obtained from the manufacturer, the distribution or suppliers, a notice shall also be given to such manufacturer, distributor or supplier.

     

    • In a case where the sample is drawn from an open container, the person drawing the sample shall also draw a sample from a container in the original condition of the same article bearing the same declaration, if such container is available and intimate the same to the food analyst.

     

    • The food safety officer or the purchaser takes a sample of an article of food for analysis, he shall pay the cost of such sample, to the person from whom the sample is taken, calculated at the rate at which the article is sold to the public.  

     

    • All bottles jars or other containers containing the samples for analysis shall be properly labeled and the parcel shall be properly addressed. the label on any sample of food sent for analysis shall bear 

                 

    1. code number of the sample 
    2. name of the sender with his official designation 
    3. date and place of collection
    4. Nature of article being sent for analysis.
    5. Nature and quantity of preservative, if any, added to the sample.

     

    • The container of the sample shall be dispatched forthwith in the following manner 

     

    1. The sealed container of one part of the sample for analysis along with the   

                     memorandum in form 6 shall be sent in a sealed packet to the food analyst under   

                     appropriate conditions to retain the integrity of the sample.

     

    1. The sealed container of the second and third parts of the sample and two copies of   

                      the memorandum in the form shall be sent to the designated officer.

     

    1.   the sealed container of the remaining fourth part of the sample and a copy of   the memorandum in Form 6 shall be sent to an accredited laboratory along with a fee prescribed by the authority, if so requested by the food business operator, under intimation to the designated officer.

    Provided that the fourth part also shall be deposited with the designated officer if food business operator does not request to send the sample to an accredited lab.

    1.   For lifting a sample for testing microbiological parameters, the method of lifting the  

                     sample, type of container, temperature to be maintained, method of transportation and 

                     the food shall notify any other condition to maintain the integrity of the sample   

                     authority from time to time. 

     

    •  The food safety officer or the authorized officer while taking samples for  

                  analysis under the provision of the act except in the case where the sample is meant for 

                  microbiological testing/analysis may add to the sample, a preservative that may be 

                  prescribed from time to time in the regulations to maintain it in a  

                  condition suitable for analysis.

    Exemption 

    Food sold in packaged condition shall be sent for analysis in its original condition without opening the package as far as practicable, to constitute approximate quantity along with the 

    original label. in case of bulk packages, wherever preservatives are to be added as per the requirement. the sample shall be taken after opening a sealed container or package in the presence of the food business operator or case of his refusal, in the presence of one or more witnesses, the contents of the original label shall also be sent along with the sample for analysis. however such samples shall not be used for microbiological analysis.

    Analysis of food samples by food analyst 

    Food laboratories including mobile food laboratories wherever required, may be established or notified by the central / state government to test food samples received from the food safety officer / purchaser.

    Period of validity for unfit sample 

    If the sample container received by the food analyst is found to be in broken condition or unfit for analysis, the food analyst shall, within seven days from the date of receipt of such sample, inform the designated officer about the same and request him to send the second part of the sample for analysis.

    Requisition 

    On receipt of requisition from the food analyst according to the designated officer, shall by the succeeding working day, dispatch to the food analyst for analysis one part of the samples sent to him by the food safety officer.

    Validity of analysis report 

    • On receipt of the sample, the food analyst shall analyse or cause to be analysed the sample and send the analysis report mentioning the analysis method. the analysis report shall be as per form 7A and four copies shall be sent to the designated officer under whose jurisdiction the food safety officer functions or the purchaser of an article of food. the analysis report shall be signed by the food analyst and such report shall be sent within fourteen days of the receipt of the sample by the food analyst.
    • The designated officer shall keep two copies of the analysis report for further action, one copy shall be sent to the food safety officer for record and one copy to the food business operator from whom the sample was taken.
    • Provided that in case the sample cannot be analysed within fourteen days of its receipt, the food analyst shall inform the designated officer and the commissioner of food safety giving reasons and specifying the time to be taken for analysis.

    Parameter for analyzing 

    The manuals of the method of analysis as amended/adopted by the authority from time to time including AOAC/ISO/Pearson’s/Jacob/IUPAC/ food chemicals CODEX/BIS/woodmen/ winton -winton/ Joslyn, shall be used for analyzing the samples of food articles. however, in case the method for analyzing any parameter is not available in these manuals, a validated method of analysis prescribed by internationally recognized / analytical/ regulatory agencies shall be adopted.

    Prosecution 

    The designated officer would analyze the report delivered by the food analyst if the designated officer finds it erroneous as addressed by the recommendation he shall forward one of the parts of the sample kept by him to the referral laboratory, for analysis and if the analysis report of such referral laboratory is to the effect that the article of food is unsafe or substandard or mis- branded or containing extraneous matter, the provision shall apply. 

    Responsibility of purchaser in food analysis 

    If the purchaser has the food article purchased by him to be analysed by the food analyst, he shall give notice in writing then and there in form 5B of his intention to have it so analysed to the person from whom he has purchased the food article. 

    Provisions 

    • The provision of mutatis mutandis applies with the modification that the samples shall be divided into two parts or two already sealed packages will be taken each of which will be marked and sealed or fastened up in such a manner as its nature permits and the signature or thumb impression of the person from whom the sample has been taken or a witness will be affixed on the label. the purchaser will forward one part of the sample to the food analyst and the other to the designated officer which can be used in the event of an appeal by the food business operator against the finding of the report of the food analyst.
    • The purchaser shall pay the prescribed fee to the food analyst for carrying out the analysis.
    • The food analyst shall send to the purchaser his report on analysis of the article of food and if the finding of the report is to the effect that the article of food is adulterated/misbranded / contaminated or does not conform to the standards prescribed under the act or the regulation, the food analyst shall also send his report in triplicate to the designated officer of the area in which the article of food was purchased, besides sending a copy of the report to the purchaser. 

    Food analysed by food business operator 

    • The food business operator from whom the sample has been taken or the person whose name and address and other particulars have been disclosed to have the fourth part of the sample analysed shall request the food safety officer to send the sample to any NABL accredited /FSSAI notified laboratory for analysis under intimation to the designated officer.
    • The food safety officer shall send the sample to a NABBL-accredited / FSSAAI-notified laboratory, under intimation to the designated officer provided that the cost of testing by the accredited lab will be borne by the food business operator.
    • The food analyst shall send copies of the analysis report to the designated officer in the proforma given in form 7A, indicating the method of analysis.

     

    Period of the report for referral laboratory 

    When an appeal as provided under subsection 4 of section 46 is preferred to the designated officer by the food business operator against the report of the food analyst, the designated officer shall if he so decides, within thirty days from the receipt of such appeal after considering the material placed before him and after allowing food business operator to be heard shall forward one part of the sample to the referral lab. such appeal shall be in form 8 which shall be filed within 30 days from the date of the receipt of the copy of the analysis report from the designated officer. report of the referral laboratory shall be final in this regard.

    Conclusion
