To address this, the Government of India created a dedicated regulatory system at the state level. That system is the State Pollution Control Board — SPCB.

    What is SPCB?

    The State Pollution Control Board (SPCB) is a statutory regulatory authority established by the government in every Indian state. Its primary responsibility is to prevent, control, and reduce pollution caused by industries, factories, and other commercial establishments operating within that state.
    It is not just a licensing body. SPCB has the legal power to inspect industries, collect environmental samples, issue directions, impose penalties, and even shut down units that are causing harm to the environment.

    Where Does SPCB Sit in the System?

    SPCB does not work in isolation. It is part of a structured hierarchy:
    Ministry of Environment, Forest & Climate Change (MoEF&CC) — Central Government, sets national policy
    Central Pollution Control Board (CPCB) — National body, sets standards and guidelines
    State Pollution Control Board (SPCB) — State level, implements rules and issues approvals
    Industries and Establishments — Must comply with SPCB requirements
    Every state has its own SPCB. In Union Territories like Delhi, the equivalent body is the DPCC — Delhi Pollution Control Committee.

    What Does SPCB Actually Do?

    At its core, SPCB does three things:
    1. It Regulates — Before any industry can be built or operated, SPCB must give its approval through CTE (Consent to Establish) and CTO (Consent to Operate). No approval means no legal right to operate.
    2. It Monitors — SPCB regularly inspects industrial units, collects water and air samples, checks pollution control equipment, and monitors whether industries are staying within permissible limits.
    3. It Enforces — If an industry is found violating norms, SPCB has full legal authority to issue closure orders, impose heavy fines, cancel operating permissions, and file criminal cases.

    4. Set Pollution Standards Define legal limits for effluents, emissions, noise, and hazardous waste disposal.
    5. Inspect Industries Physically inspect factories, collect samples, and verify pollution control equipment is working.

    Types of SPCB Certifications 

    1. CTE — Consent to Establish -Permission before constructing a factory or industrial unit.
    2. CTO — Consent to Operate- Permission before starting production or operations.
    3. HWM Authorization — Hazardous Waste Management -For industries generating, storing, or disposing hazardous waste.
    4. BMW Authorization — Bio Medical Waste- For hospitals, clinics, labs generating medical waste.
    5. E-Waste Authorization- For manufacturers and recyclers of electronic equipment.
    6. Plastic Waste Management Authorization- For manufacturers and importers dealing in plastic products.
    7. Environmental Clearance (EC) -For large projects like power plants, mining, highways.
    8. Annual Environmental Statement (AES)- Yearly compliance report submitted by all CTO holding industries.
    9. Stack Emission NOC- For industries with chimneys or boilers releasing air emissions.
    10. Solid Waste Management Authorization- For large generators of industrial or municipal solid waste

    Validity of SPCB Consent

    Validity depends on state rules and industry category, but generally:

    1. Consent to Establish (CTE)

    • Can be extended if project is delayed

    2. Consent to Operate (CTO)

    Typical validity:

    • Red Category: 3–5 years
    • Orange Category: 5–10 years
    • Green Category: 10–15 years

    In many states, CTO renewal is required periodically, often every 5 years.
